Welcome to FocusMelo. These Terms of Use govern your access to and use of our website and its features. Please read them carefully, together with our Privacy Policy and the terms applicable to any purchase you make.

In these Terms, “FocusMelo”, “we”, “us”, and “our” refer to FocusMelo Limited.

2. Use of our website

You may use our website to browse products, place orders, manage your purchases, and access the services we provide.

You agree to use the website lawfully and not to:

• Submit false or misleading information or impersonate another person.

• Attempt to access accounts, systems, or information without authorisation.

• Introduce malware or interfere with the security or operation of the website.

• Use the website to commit fraud or infringe another person’s rights.

• Collect other users’ personal information without a lawful basis.

• Reproduce or commercially exploit protected website content without the necessary permission.

Nothing in these Terms restricts uses permitted by applicable law.

3. Intellectual property

Rights in that material belong to FocusMelo or the respective rights holders. The appearance of third-party artwork, artist names, trademarks, or platform names does not, by itself, imply a partnership or endorsement.

You may view website content for personal use and retain copies of information relating to your orders. Any other reproduction, modification, distribution, or commercial use requires permission from the relevant rights holder, unless permitted by law.

Purchasing a product does not transfer copyright or other intellectual property rights in its design, artwork, or associated music.

4. Customer accounts

If you create an account, you must provide accurate information and keep your account details up to date.

You are responsible for taking reasonable steps to protect your login credentials and prevent unauthorised access.

Please notify us promptly at contact@focusmeloworld.com if you suspect that your account has been compromised.

You are not automatically responsible for unauthorised activity solely because it occurred through your account. Responsibility will depend on the circumstances and applicable law.

5. Personalised products and submitted content

When you submit photographs, images, text, links, or other content for a personalised product, you must have the rights and permissions necessary for us to use that content for the requested purpose.

You retain any rights you hold in your submitted content. You grant FocusMelo and the production providers involved in your order a limited, non-exclusive permission to reproduce, format, and use it as necessary to prepare, manufacture, deliver, and support your personalised product.

This permission does not grant us a general right to use your personal photographs or other submitted content in advertising.

We may decline content that is unlawful or infringes another person’s rights. If this affects an order already placed, we will contact you to resolve the matter in accordance with applicable law.

The handling of personal information contained in submitted content is explained in our Privacy Policy.

6. Website information and purchases

We take reasonable care to keep product descriptions, prices, and other website information accurate. However, errors or omissions may occur.

We may correct information and update the website. Such updates do not automatically change the terms of an order already accepted.

If an error affects your order, we will contact you and explain the available resolution in accordance with applicable law. We will not impose an increased price on an accepted order without your agreement.

The purchase, payment, delivery, cancellation, and return terms disclosed before you place an order apply to that purchase, together with your statutory rights.

7. Klarna payment options

Where available, Klarna may be offered as a payment option at checkout.

Depending on your country, the order, and Klarna’s eligibility requirements, available options may include:

• Payment in full.

• Deferred payment.

• Payment in instalments.

The options actually available, payment schedule, and any applicable charges or interest are shown during the payment process. Availability and approval are determined by Klarna.

Klarna may carry out identity, fraud prevention, or creditworthiness checks, depending on the selected service and applicable requirements.

If you choose Klarna, the terms presented by Klarna for that payment service apply in addition to the terms governing your purchase from FocusMelo.

You can select your country to review the relevant Klarna Terms and Conditions.

Questions about your Klarna account or payment schedule should be directed to Klarna. Questions about your products, delivery, returns, or refunds should be directed to FocusMelo. Paying through Klarna does not remove our responsibilities as the seller.

8. Personal information and Klarna data sharing

Our collection and use of personal information are described in our Privacy Policy.

Where Klarna is available, certain contact and order information may be shared with Klarna during checkout to assess eligibility, present payment options, and process the selected service.

Klarna processes information under its own privacy notice. Please select your country to read the relevant Klarna Privacy Policy.

Acceptance of these Terms does not, by itself, constitute consent to optional marketing or non-essential tracking.

9. Third-party websites and services

Our website and connected products may link to services operated by third parties, including music platforms and payment providers.

Those services have their own terms, privacy policies, and availability requirements. Access may require a compatible device, an account, or a separate subscription.

Unless expressly included in the product offer, purchasing a FocusMelo product does not include a subscription to a third-party music service.

We do not control the content or operation of independent third-party websites. However, this does not exclude responsibility for our own statements, actions, or obligations, or affect your rights if a product fails to perform as described.

10. Our responsibility

We remain responsible for fulfilling our obligations under applicable law and any contract we enter into with you.

We take reasonable care in operating our website but cannot guarantee uninterrupted access. Maintenance, technical faults, and other interruptions may occur.

To the extent permitted by applicable law, we are not responsible for losses caused solely by your unlawful use of the website or for losses that are not attributable to our breach of duty.

Nothing in these Terms excludes or limits liability for:

• Fraud or fraudulent misrepresentation.

• Death or personal injury caused by our negligence.

• Any other liability that cannot legally be excluded or limited.

Nothing in these Terms removes your mandatory rights concerning defective products, non-delivery, refunds, or other consumer remedies. These protections also apply when you use Klarna or another payment provider.

11. Changes to these Terms

We may update these Terms to reflect changes in applicable law, security requirements, or the features and operation of our website.

The updated version will be published on this page with its effective date. We will provide additional notice or obtain agreement where required by law.

Changes will not retroactively alter an existing purchase contract without a lawful basis and any agreement required from you.

12. Governing law and disputes

These Terms are governed by the laws of Hong Kong.

If you are a consumer, this choice of law does not deprive you of any mandatory consumer protections available under the law of your country of habitual residence where those protections apply.

Subject to mandatory jurisdiction rules, the courts of Hong Kong have non-exclusive jurisdiction. Nothing in these Terms prevents you from bringing proceedings in the courts of your place of residence where applicable law gives you that right.

You may contact us to seek an informal resolution of a concern. Doing so is not a condition for exercising your legal rights.

13. Validity of individual provisions

If a provision of these Terms is found to be unlawful or unenforceable, it will not bind you to the extent of that invalidity.

The remaining provisions will continue to apply where the Terms can legally remain in effect without the invalid provision.
